Assumed Name Certificates
(‘DBA’ - Doing Business As)
General Information
According to the Business and Commerce Code, Section 36.10 and 36.15, each person who regularly conducts business or renders professional services other than as a corporation, limited partnership, registered limited partnership, or limited liability company in the county must file its Assumed Name Certificated (also known as “d.b.a.” or “doing business as”) with the clerk so that a record is available as to the owner’s businesses. Assumed Name Certificates must be filed according to these guidelines:
- An Assumed Name Certificate must be filed to begin a business.
- Assumed Name Certificates are good for 10 years, or a shorter period of time if stated in the certificate.
- An Assumed Name Certificate must be filed in the county where you plan to conduct business.
- An applicant may have more than one (1) Assumed Name.
- There may be more than one (1) registrant per Assumed Name.
Procedures to Obtain Assumed Name
In Person:
- Download attached Assumed Name Certificate Application (see below) or obtain application from clerk.
- Complete application and sign in front of a clerk (notary not necessary if signed in front of clerk).
- Pay appropriate fee (see applicable fee section below).
- Completed application will be processed and returned to you immediately.
By Mail:
- Download attached Assumed Name Certificate Application and Business Type Definitions (if needed).
- Complete application, sign in front of a notary and mail (with appropriate fee) to:
- The recording fee is $15 per application (which includes one owner name), with an additional fee of $.50 added for each additional owner. A check or money order, payable to the Laura Hughes, County Clerk, must accompany the written request
4. Once processed, the document will be returned to you by mail, within 7-10 business days
Applicable Fees
- The fee for an Assumed Name Certificate to be filed and recorded is $15.00 (this includes one owner name).
- There is additional fee of $0.50 added for each additional owner.
Types of Payments Accepted
- Cash (for your protection, please don’t mail cash!)
- Check or Money Order – Made payable to Laura Hughes County Clerk
- Credit Card (Visa, MasterCard, American Express or Discover)
Must include a daytime phone number if you are paying by credit card.
